The Ultimate Rule of Law - David M. (professor Of Law Beatty - Bog - Oxford University Press - Plusbog.dk

The Ultimate Rule of Law - David M. (professor Of Law Beatty - Bog - Oxford University Press - Plusbog.dk

The Ultimate Rule of Law addresses the age-old tension between law and politics by examining whether the personal beliefs of judges come into play in adjudicating on issues of religious freedom, sex discrimination, and social and economic rights. Decisions by the Supreme Courts of India, Japan, Canada, the United States, Ireland, Israel, the Constitutional Courts of Germany, Hungary, South Africa, and the European Court of Human Rights on such controversial issues as government funding of religious schools, abortion, same sex marriages, women in the military, and rights to basic shelter and life saving medical treatment are evaluated and compared. Beatty develops a radical alternative to the conventional view that in deciding these cases judges engage in an essentially interpretative, and thus subjective act, relying ultimately on their personal beliefs and political opinions. His analysis shows that it is possible to apply an impartial and objective method of judicial review, based on the principle of proportionality, which acts as an ultimate rule of law and is fully compatible with the ideals of democracy and popular sovereignty. Controversially, Beatty concludes that although this method of judicial review originated in the United States, American judges generally appear to be far less inclined to this conception of constitutional adjudication than their counterparts in Europe, Africa, and Asia.

God, Purpose, and Reality - John Bishop - Bog - Oxford University Press - Plusbog.dk

What must reality be like if the God of Abrahamic theism exists? How could the worldview of Abrahamic theism be understood if not in terms of the existence of a supremely powerful, knowledgeable, and good personal being? John Bishop and Ken Perszyk argue that it is reasonable to reject what many analytic philosophers take to be the standard conception of God as the ''personal omniGod''. They argue that a version of a ''logical'' Argument from Evil is still very much in play, contrary to the widely held view that this line of argument is bankrupt. This book provides a new presentation and defence of the alternative that Bishop and Perszyk have called euteleology. Its core claims are that reality is inherently purposive, and that the Universe exists ultimately because its overall end (telos), which is the supreme good, is made concretely real within it. There is no supreme agent (''standing by'' while horrors take place); God is ''no-thing'' in euteleology''s basic ontology. Rather, talk of God-as-a-personal-being is a cognitive construction, treating ultimate reality by analogy with our ordinary ways of experiencing and talking about the world. But euteleological theism is also emphatically realist. Analogizing God-talk enables humans to align themselves with reality and is aptly deployed in prayer and worship-practices whose broad function is a human contribution to, and enjoyment of, the fulfilment of reality''s inherent ultimate purpose.

Freedom and Responsibility in Neoplatonist Thought - Ursula Coope - Bog - Oxford University Press - Plusbog.dk

Freedom and Responsibility in Neoplatonist Thought - Ursula Coope - Bog - Oxford University Press - Plusbog.dk

The Neoplatonists have a perfectionist view of freedom: an entity is free to the extent that it succeeds in making itself good. Free entities are wholly in control of themselves--they are self-determining, self-constituting, and self-knowing. Neoplatonist philosophers argue that such freedom is only possible for non-bodily things. The human soul is free insofar as it rises above bodily things and engages in intellection, but when it turns its desires to bodily things, it is drawn under the sway of fate and becomes enslaved. Ursula Coope discusses this notion of freedom and its relation to questions about responsibility. She explains the important role of notions of self-reflexivity in Neoplatonist accounts of both freedom and responsibility. In Part I, Coope sets out the puzzles Neoplatonist philosophers face about freedom and responsibility and explains how these puzzles arise from earlier discussions. Part II explores the metaphysical underpinnings of the Neoplatonist notion of freedom (concentrating especially on the views of Plotinus and Proclus). In what sense, if any, is the ultimate first principle of everything (the One) free? If everything else is under this ultimate first principle, how can anything other than the One be free? What is the connection between freedom and nonbodiliness? Finally, Coope considers in Part III questions about responsibility, arising from this perfectionist view of freedom. Why are human beings responsible for their behaviour, in a way that other animals are not? If we are enslaved when we act viciously, how can we be to blame for our vicious actions and choices?

The Predicament of Belief - Steven Knapp - Bog - Oxford University Press - Plusbog.dk

The Predicament of Belief - Steven Knapp - Bog - Oxford University Press - Plusbog.dk

Does it make sense - can it make sense - for someone who appreciates the explanatory power of modern science to continue believing in a traditional religious account of the ultimate nature and purpose of our universe? This book is intended for those who care about that question and are dissatisfied with the rigid dichotomies that dominate the contemporary debate. The extremists won''t be interested - those who assume that science answers all the questions that matter, and those so certain of their religious faith that dialogue with science, philosophy, or other faith traditions seems unnecessary. But far more people today recognize that matters of faith are complex, that doubt is endemic to belief, and that dialogue is indispensable in our day. In eight probing chapters, the authors of The Predicament of Belief consider the most urgent reasons for doubting that religious claims - in particular, those embedded in the Christian tradition - are likely to be true. They develop a version of Christian faith that preserves the tradition''s core insights but also gauges the varying degrees of certainty with which those insights can still be affirmed. Along the way, they address such questions as the ultimate origin of the universe, the existence of innocent suffering, the challenge of religious plurality, and how to understand the extraordinary claim that an ancient teacher rose from the dead. They end with a discussion of what their conclusions imply about the present state and future structure of churches and other communities in which Christian affirmations are made.
